§ 1 Scope

These Terms and Conditions apply to all orders placed by consumers through the online store glowupspirit.com with SCYENTIFIC BRANDS LLC, 5830 E 2nd St, Ste 7000 #35063, Casper, Wyoming 82609, USA (hereinafter "we" or "GlowUp Spirit").

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Conclusion of contract

The presentation of products in the online store does not constitute a legally binding offer, but an invitation to order. By clicking the "Buy now" or "Place binding order" button, you submit a binding order for the goods in your cart. We confirm receipt of your order by email immediately after you place it. The purchase contract is concluded with our order confirmation or with the shipment of the goods.

§ 3 Prices and shipping costs

All prices shown are final prices in euros and include any applicable statutory VAT. Shipping within Germany is free.

§ 4 Delivery

We deliver within Germany. Delivery usually takes 2 to 5 business days after receipt of payment, unless stated otherwise on the product.

§ 5 Payment

Payment is made using the methods offered during checkout (for example credit card, PayPal, Klarna, Apple Pay, Google Pay). Any restrictions are shown during checkout.

§ 6 Subscriptions (Subscribe and Save)

We offer a subscription for selected products (for example 1 pouch per month or 3 pouches every 3 months). The subscription renews automatically for the respective delivery period until it is cancelled. You can cancel at any time, with no notice period, effective from the next delivery: via the link in your subscription confirmation email, in your customer account, or by emailing support@glowupspirit.com. Deliveries already paid for and shipped are not affected by the cancellation.

§ 7 Retention of title

The goods remain our property until payment has been made in full.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. You will find the details in our Right of Withdrawal notice. In addition, we grant a voluntary 30 day money back guarantee.

§ 9 Warranty

Statutory rights regarding defects apply.

§ 10 Health notice

Our products are dietary supplements and are not a substitute for a balanced, varied diet and a healthy lifestyle. Do not exceed the recommended daily serving. Keep out of reach of young children. If you are pregnant or breastfeeding, have a medical condition, or take medication, please speak with your doctor before use.

§ 11 Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

§ 12 Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
